We are working with a vendor who preinstalled Windows Server 2003 R2 SP2 on 9
servers and shipped them to us. They installed the operating system using
EOM software, and they are trying to tell us we can use or Volume License
keys. Well so far it isn't working and I don't think it can, but the vendor
of course just thinks I am an idiot and can't follow instructions. I found
KB Article ID: 328874 whcih to me is rather definitive in the first paragraph
that this won't work. But the vendor.....Could someone enlighten me as to
what the case here? I am in the camp that this won't work. Please enlighten
me and show me the way....

I agree with you. An OEM setup program is unique and is different from both
a VL copy or a retail copy.

The vendor is legally supposed to put the "sticker" on the external suface
of the server in a visible place the contains a valid OEM key that the OS
can be installed with,...and they need tro give you an actual OS disk in
some usable form (like a real disk or a hidden partition that you can boot
from). Obviously each server is supposed to have a different OEM Key.

If they still think you are an idiot,...show them how any old idiot can use
a little legal leverage with them.

With Server 2003 OEM, Retail and Volume are different media. You can't
change keys between them. With Server 2008 you can.
OEM licenses are considerably cheaper because they are tied to one machine
and non-transferable.
A Select agreement entitles you to re-image a computer and upgrade to a
volume license, provided the original was supplied with an OEM license (in
other words, someone somewhere needs to have bought a full license). Maybe
this is what is confusing them. You could reimage the computers, but what
would be the point?

Seems like the vendor in this case doesn't know the difference between OEM
and VL operating systems. I'm not suprised, it happens a lot with consulting
firms, not just with this, but with other issues as well when it comes to
product knowledge.

I agree with Phillip. Follow his suggestions.

Hello GrumpyinMinneapolis,
You are reading the article correctly, what they are suggesting will not
work.
You cannot change a product key from one media type to a produc key from a
different media type when using Windows Server 2003
( OEM, Volume, Retail, Eval - different media types, requiring different
product keys,)
